Santa Clara Child Molestation Defense Lawyers

Many people immediately consider a person accused of child molestation or child sexual abuse as guilty and incapable of rehabilitation. At the law office of Hinkle, Jachimowicz, Pointer & Emanuel, we don't make those kinds of judgments. We stand firm for our clients and defend their rights.

If you've been charged with a child sex crime in Santa Clara County, contact the California child molestation criminal defense lawyers at Hinkle, Jachimowicz, Pointer & Emanuel. Three of our five criminal defense lawyers worked in law enforcement prior to joining our firm. They understand how police investigations into child sex crimes can go wrong and become tainted by the beliefs of others.

Our attorneys have defended coaches, teachers, parents and others accused of:

  • Inappropriate touching over clothing
  • Sexual intercourse with a minor (statutory rape)
  • Child molestation

Be Careful When Talking on the Phone

Often when a person is accused of child sexual abuse, the charge comes from someone with a motive to hurt the accused. This can be an ex-spouse, a disgruntled relative, a neighbor or co-worker.

The first inkling the accused may have that something is wrong is when he or she receives a "pretext" phone call from the accusing adult or child who is often reading from a script provided by the police. The phone call is secretly being recorded.

Usually in this call, the person is told, in a non-accusing manner, that the child is feeling very badly about what happened between the accused and the child. The speaker will try to get the accused to admit some kind of participation, even if it's only to say that the person is sorry "if anything ever happened." What may be considered a statement of sympathy from the adult can then be used by the police as a confession. This is confusing to many people who had nothing to confess.

Our firm is committed to ensuring you receive fair treatment both in a court of law and in the court of public opinion. We frequently use psychologists and other mental health experts to determine if our clients are mentally ill, or if they have issues with drug or alcohol addiction. We interview witnesses and challenge variations of stories to ensure that victims are telling the truth about the alleged sexual abuse. A forensic psychologist is usually hired to prove that our client is not a pedophile.
